Good luck with the law if you accept and serve UGC and happen to store (let alone serve) any from a child who’s under the age of 13. There’s no reason why these sites shouldn’t shoulder their share of the responsibility to prevent children from accessing this content. I’m not going to shame people for it; hell, I had a hamburger yesterday. This was obvious in the Girls Do Porn case, where 22 girls were coerced into having sex by now fugitive founder Michael Pratt, in which the videos were uploaded to Pornhub without their consent. In each of the crimes above, Pornhub has capitalized on views to earn money by advertising. With every video upload, Pornhub retains the right to monetize that video with advertisements.

Fraud, one of the indicators of sex trafficking, was present in their case. And their videos were posted on several websites including Pornhub, now under fire for hosting videos of the rape of minors among other things. Millions of images and videos of CSAM are found and removed from the web every year.

Pornhub’s parent company has agreed to pay more than $1.8 million to resolve a criminal probe alleging it profited from sex trafficking through its hosting of videos produced by San Diego-based GirlsDoPorn.com. The women alleged they were coerced to film pornographic videos or led to believe their videos would only be distributed to private owners, rather than proliferated online on GirlsDoPorn’s subscription website, as well as numerous free sites, many of which are owned by MindGeek. Michael James Pratt disappeared in the summer of 2019, just before he was indicted on federal conspiracy and sex trafficking charges stemming from what prosecutors said was a decade-long scheme to con hundreds of teens and young women into appearing in adult videos for the website he owned.

Garcia’s victims were coerced, defrauded and forced to participate in recorded sex acts, some of which were violent to the point of drawing blood. Pornhub’s purge of millions of videos, presumably including many of the videos in which the plaintiffs appeared, was announced on December 14. Another one of the Jane Doe plaintiffs in January 2016 “submitted a content removal request to MindGeek, begging to have her video removed because of the lack of consent and harassment she was under,” the complaint said.
